a. Our Contract
When you make a request to purchase products from us we will send you a formal quote by e-mail. Unless otherwise stated, this quote will be valid for 48 hours. You accept our quote by responding to this e-mail. This response will constitute your acceptance of the order and from that point you are liable to pay for the order. When you place an order, you will also receive an acknowledgment e-mail confirming receipt of your order. This e-mail will constitute acceptance of your order. A final invoice will be sent by e-mail when the goods which you ordered have been dispatched to you.
b. Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. Our prices may also fluctuate based on currency fluctuations and are subject to change.
If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled.
c. VAT
Unless otherwise noted, all prices are exclusive of VAT. Because most of our custom-made products are produced in the EU, if you are a UK customer then VAT at UK rate (currently 20%) will be payable by you on customs clearance (as per new post-Brexit regulations and procedures from January 1st, 2021).
This process is quick and simple though. Once our courier service (UPS) receives the goods they will email you with a payment link. As soon as they receive the payment they will clear the goods at customs, and deliver them to you. VAT-registered businesses can account for import VAT on their VAT Return and claim back the VAT that way.
Please note that because of the new post-Brexit regulations we now also need to add the client’s VAT/EORI number or TIN (Tax Identification Number) on the shipping note, so the items can be cleared by UK customs. The TIN for most people in the UK is simply your National Insurance number.
If you’re VAT registered, please provide us with your VAT and EORI number when you place your order. This way, we can give this info to our courier service (UPS) in advance, and they can clear your goods at UK customs.
For information, an EORI number is used to identify businesses that want to import (or export) physical goods from (or to) another country (https://www.gov.uk/eori). Since 1 January 2021 (Brexit), this includes EU countries. The EORI number is used for completing customs formalities and is the way that customs authorities identify who is importing or exporting goods.
You can apply for an EORI number on the government website here: https://www.gov.uk/eori/apply-for-eori
You’ll generally get your GB EORI number immediately when you follow the application link and instructions.
d. Delivery Charges
Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable on the quote and included in the “Total Cost”.
e. Deposit
We reserve the right to request a deposit to be paid before we start production of your order. It is the sole discretion of ScarvesNall.uk to determine the amount of the deposit (up to 80% of the total value of the order). If for any reason we cannot fulfill or deliver your order after the deposit was received, we will refund your deposit within 14 days of our notification to you of the cancellation of the order, provided you supplied us with your bank account wire details. If you cancel an order before production has started and you have already paid a deposit, you will receive a full refund of your deposit.
f. Over or Under Production
For items for which require a custom design or customer customisation there is always a possible deviation of the ordered number of maximum 10% (more or less). The number delivered will be
invoiced. If a higher deposit was already paid, a credit note to be drawn up and refund paid to your bank account.
g. Payment
Once your goods are dispatched we will send you an invoice via e-mail. Unless otherwise stated you are obligated to pay the invoice within 21 days of receipt by the MultiSafepay link provided with the invoice. We may request payment before the goods are dispatched to you. Please note that paying by cheque is NOT possible or allowed..
h. Late Payments
ScarvesNall.uk and it’s parent companies reserve the right to charge interest at prevalent rates and any other costs related to payment recovery if the payment is not received by the invoice due date or payment term stated in the previous section. Costs include and or not limited to administration fees which are levied to chase the payment. When the payment is more than one month overdue, we employ a debt collection agency. Once we employ the agency the latest invoice will directly increase with a minimum of 25% to cover the extra costs, and all additional agency costs and fees will be claimed back as well.
i. Order Cancellations
Unless otherwise stated, any orders which are cancelled before we start the full production run are liable to a fee of up to 25% of the order value (to cover the cost of the design, equipment set-up and sample.
j. Returns
It is your responsibility to check and verify the products when you receive them and notify us within 48 hours of any problems, with detailed pictures of the perceived issues. We will review these with our production team and the liability of any returns will be assessed on a case per case basis.
k. Manufacturing Set-up Charges
Please note that we waive the standard production set-up costs on all invoices paid within the agreed payment term (standard 3 weeks). For invoices not paid within this period, the standard set-up charges will be applied to the overdue invoice. These are £100 per production run.
l. Invoicing
Please note that scarvesnall.uk invoices through Fanshops.be, our head office in Belgium. Various reasons let us to change this procedure. In essence, this means we can now accept payments through MultiSafepay, giving you the option to pay by credit/debit cards as well, in addition to UK and international bank wires.
